GENERAL TERMS AND CONDITIONS OF SALE FOR ENTRANCE TICKETS TO MONUMENTS MANAGED BY ORANGE EDEIS – ROMAN THEATER, ART AND HISTORY MUSEUM, ARC DE TRIOMPHE

PREAMBLE
All ticket orders placed on the www.theatreantique.com/billetterie website imply exclusive acceptance of these terms and conditions of sale.

ARTICLE 1: TICKETS FOR SALE TO INDIVIDUALS
1.1. Services to which tickets entitle the holder Tickets entitle the holder to access the sites managed by Orange Edeis: the Roman Theater in Orange, the Musée d’art et histoire d’Orange and the Arc de triomphe for a defined period.

1.2. Each ticket issued is valid only for the period indicated on it.

1.3. Ticket availability The customer is informed of ticket availability in real time when the order is placed.

1.4. Family Pass A special rate is available for families comprising two adults and two children aged 7 to 17. The corresponding ticket can be purchased on site or online. Family members must present themselves at the same time for ticket control, with proof of the children’s ages.

ARTICLE 2: GROUP TICKETS ON SALE

Group passes give access to the sites managed by Orange Edeis: the Roman Theater in Orange, the Musée d’art et histoire d’Orange and the Arc de triomphe for a defined period, at a preferential rate. The minimum group size is 20 people. Below this number, the individual rate corresponding to the visitor category will be applied.

2.1. School groups The school group rate applies to all groups of people aged 17 and under. One accompanying adult is admitted free for every 8 paying children (the teacher is considered an accompanying adult). One driver per group is free.

2.2. Adult groups The adult group rate applies to all groups of people aged 18 and over. Admission for one accompanying adult and one driver per group is free.

ARTICLE 3: FREE ACCESS
Access to the sites managed by Orange Edeis is free for the following categories: children under 7 years of age, holders of a disability card and their companion, journalists, heritage workers, tour guides, curators, researchers, archaeologists, journalists, City of Orange staff working on the sites, residents of the City of Orange (outside the periods of animations and events). Free admission can only be granted at the cash desk, and on presentation of a valid receipt.

ARTICLE 4: RATES FOR SERVICES AND ORDER PRICES
The site offers several rates depending on the type of visit concerned, as well as the age and status of the beneficiary of the admission fee. Visit prices are displayed on the site managed by Orange Edeis at the time the order is placed. The total price displayed when the order is validated is the final price, including all taxes and administration costs. It is included in the confirmation e-mail and the invoice. Visit prices and total prices are displayed in euros. Orange Edeis reserves the right to revise prices at any time.

ARTICLE 5: ORDERING TICKETS
The online ordering procedure comprises the following steps:

  • 1) The Customer selects the ticket(s) of his/her choice. For each ticket, the Customer chooses the day and time, if applicable, and the number of tickets corresponding to a given price.
  • 2) The customer creates a customer account or connects to his customer account by entering a login and password. The creation of a customer account implies the communication of the information required to process the future order: first and last name, address, telephone number, e-mail address and date of birth.
  • 3) The summary shows the entire order. Once the order has been checked and the present terms and conditions have been read, the customer pays for the order online. In the event of refusal by the payment center concerned, the order is automatically cancelled. Payment by the Customer constitutes irrevocable acceptance of the order.
  • 4)The customer receives an order confirmation email with his invoice and admission tickets.

5.1. Group reservations Reservations are recommended for groups. Please contact the groups department by e-mail. All group bookings must specify the number of visitors, the name and contact details of the group leader, the date, time and service required. The booking conditions will be formalized in writing by means of a booking contract. All visitors making up the group must be present before checkout. In the event of cancellation, please give at least 72 hours’ notice. In the event of cancellation after this time, the guide service will be charged in full. Payment for tours must be made in advance by the group leader at the cash desk on the day of the tour, or by invoice only if specified in the booking contract.

5.2. Special conditions for conferences and educational workshops These services must be booked for all groups. Unless otherwise stipulated in the booking contract, failure to comply with these conditions will result in cancellation of the service. No deposit is required, except in specific cases. Groups paying by money order or voucher must send the order form at least 10 days before their visit. The invoice, payable on receipt, will be sent after the visit. Any delay will reduce the effective duration of the visit. Any delay of more than 30 minutes will be considered as a cancellation, and the cost of the service will be retained.

ARTICLE 6: PAYMENT TERMS AND CONDITIONS

6.1. Payment methods Payment for tickets by the customer is made exclusively in euros and by credit card.

6.2. Payment transactions The customer’s bank account is debited with the amount of the order as soon as the transaction has been accepted by the payment center. If the payment center refuses, the order is automatically cancelled.

6.3. Invoice Once the transaction has been completed, the customer can obtain an invoice by logging on to his customer account.

6.4. Group payment methods Payment can be made by cash, credit card (Visa, Mastercard, American Express) or cheque (payable in France) to Orange Edeis. Money orders, vouchers and bank transfers are accepted only after approval by the reservations department.

6.5. Pre-sale tickets for tourism professionals and works councils Tickets can be purchased in advance for a minimum of 20 tickets, adults and children combined. Admission tickets are valid for a maximum of 1 year from the date of issue (unless otherwise indicated on the ticket). Event tickets are valid only for the date indicated on the ticket. Tickets are sent by registered mail with acknowledgement of receipt at a cost of €7. Tickets are dispatched once payment has been received (cheque, credit card or bank transfer). Pre-sale tickets can be collected and paid for directly at the box office on request. Pre-sale tickets are neither exchangeable nor refundable.

6.6. Payment security Payment by credit card is made via the secure bank servers of our partner (PAYBOX). This means that no banking information concerning you is transmitted via the online sales site. Payment by credit card is therefore perfectly secure. The order is registered and validated as soon as payment has been accepted by the customer’s bank. Credit card details are encrypted using SSL (Secure Socket Layer) protocol, and are never transmitted unencrypted over the network. Payment is made directly to the bank. Orange Edeis has no access to these details, and does not store them on its servers. This is why they are requested again for each new transaction on our site.

ARTICLE 7: ORDER CONFIRMATION

As soon as the payment has been validated by the payment center, the Customer receives an order confirmation e-mail. This e-mail acknowledges receipt of the order and contains the following information:
– Date and time of the order
– Main characteristics of the ticket(s) sold
– Unique order number
– Total amount of the order

ARTICLE 8: TICKET DELIVERY

The ticket(s) ordered is/are, at the Customer’s option : – Either downloaded by the Customer from his/her Customer account, in pdf format and printed on A4 paper from a printer connected to a computer, in color or black and white; – Or downloaded by the Customer to his/her cell phone from his/her Customer account.

ARTICLE 9: CONDITIONS FOR USING TICKETS

All tickets are systematically checked at the entrance to the site. This involves scanning the QR code on the ticket. Only tickets with this digital code and perfectly legible information will be accepted. It is the customer’s responsibility to ensure that on the day of the visit: – the ticket is printed on a blank sheet of A4 paper, in color or black and white; – the ticket contains a QR code and perfectly legible information. Partially printed, soiled, damaged or illegible tickets will not be accepted. Tickets with a reduced rate must be presented with proof of this reduced rate (student card, proof of employment, Education Pass, proof of address, etc.). The ticket is only valid for the visit and period indicated on it. The ticket must be kept until the end of the visit. Orange Edeis reserves the right to refuse entry to the site in the event of presentation of a ticket that does not comply with the present conditions.

ARTICLE 10: FRAUDULENT USE – LOSS – THEFT OF TICKETS

It is strictly forbidden to reproduce, duplicate or counterfeit a ticket in any way whatsoever. The reproduction of a ticket will not provide any benefit. Any person who illegally reproduces a ticket and/or uses a counterfeit ticket is liable to prosecution. Orange Edeis will refuse access to the site to any bearer of a ticket containing a QR code that has already been scanned.

ARTICLE 11: CONDITIONS FOR TICKET REFUNDS AND EXCHANGES

11.1. In accordance with article L 121-20-4 of the French Consumer Code, the online purchase of an undated ticket may be the subject of a request for reimbursement within the legal period of 14 days. After this period, any ticket issued may not be exchanged or refunded, except in the event of cancellation by Orange Edeis of the service to which the ticket entitles under the conditions defined in article 11.3. The right of withdrawal cannot be exercised for the remote purchase of “accommodation, transport, catering and leisure services”, ordered as a package or separately, for a specific date or periodicity. Consequently, the customer does not benefit from a withdrawal period for dated ticket orders, shows and special events.

11.2. Cancellation is however excluded when it results from a case of force majeure as defined in article 12.

11.3. In the event of cancellation by Orange Edeis of the service shown on the ticket, Customer Service will contact you as soon as possible by e-mail or telephone to inform you of this and will offer you : – either, if possible, with the same ticket, the rescheduling of the service concerned to a different day and/or time; – or the refund of the ticket concerned, specifying the terms and conditions.

11.4. All requests for ticket exchanges and/or reimbursements must be made to the Customer Service Department, whose contact details can be found on the theatre-antique.com/ticketing website.

ARTICLE 12: FORCE MAJEURE

Orange Edeis may not be held liable for any non-performance caused by force majeure. In particular, the following are considered to be cases of force majeure by the jurisprudence of French courts and tribunals: total or partial strikes, whether internal or external to Orange Edeis, the blocking of means of transport or supply for any reason whatsoever, governmental or legal restrictions.

ARTICLE 13: EVIDENCE, STORAGE AND ARCHIVING

The computerized registers, kept in the computer systems of Orange Edeis or any service provider of the latter, under reasonable conditions of security, will be considered as proof of the sales contract, its date, orders and payments made. Orders and invoices will be archived on a reliable and durable medium in such a way as to correspond to a faithful copy, in accordance with article 1366 of the French Civil Code.

ARTICLE 14: PROTECTION OF PERSONAL DATA

When placing an order, the customer is asked to provide personal data (surname, first name, address, e-mail address, telephone number and date of birth). This data is required to process and monitor the order, and is also used in the event of a postponement or cancellation of the service to which the ticket gives access. The personal data collected is processed by the company Orange Edeis, in the name and on behalf of Orange Edeis, in compliance with the legal provisions relating to the protection of personal data arising from the French Data Protection Act no. 78-18 of January 6, 1978. At any time, the Customer has the right to access, modify, rectify and delete data concerning him/her. They may exercise this right by writing to Customer Services at Orange Edeis – Musée d’art et histoire – Rue Madeleine Roch – 84100 ORANGE.

ARTICLE 15: FULL TERMS AND CONDITIONS

The Customer and Orange Edeis acknowledge that these general terms and conditions of sale constitute the entire agreement between them. If, for any reason whatsoever, any clause of these general terms and conditions should be declared inapplicable, it shall be deemed unwritten, without invalidating these general terms and conditions or altering the other provisions of the general terms and conditions.

ARTICLE 16: SETTLEMENT OF DISPUTES

The present terms and conditions, as well as any order placed by the Customer, are governed by French law. Any complaint must be made in an appropriate manner, allowing proof of the disputed fact to be preserved, specifying the details of the dissatisfaction as well as the order number. All claims must be made to the company Orange Edeis by post to the following address: Orange Edeis Musée d’art et histoire – Rue Madeleine Roch – 84100 ORANGE. If no satisfactory response is received within 60 days of the complaint being sent, the customer may refer the matter to the “Médiateur du Tourisme et du Voyage”, whose contact details and procedures are available on the http://www.mtv.travel website.

 

GENERAL CONDITIONS OF SALE FOR TICKETS TO THE ODYSSÉE SONORE PREAMBLE

All ticket orders placed on the www.odysseesonore/billetterie website imply exclusive acceptance of the present terms and conditions of sale. As L’Odyssée Sonore is a night-time immersive show, it is essential to be vigilant about the risk of falling, and to keep children under supervision.

ARTICLE 1: TICKETS FOR SALE TO INDIVIDUALS

1.1. Ticket entitlements Tickets entitle the holder to access to the Odyssée Sonore show, produced at the Roman Theater in Orange, for a defined period. The show is open to children aged 7 and over.

1.2. Each ticket issued is valid only for the period indicated on it.

1.3. Ticket availability The customer is informed of ticket availability in real time when the order is placed.

1.4. Family Pass A special rate is available for families comprising two adults and two children aged 7 to 17. The corresponding ticket can be purchased on site or online. Family members must present themselves at the same time for ticket control, with proof of the children’s ages.

1.5 Combined tickets A combined ticket is also available, allowing visitors to discover the 3 Orange monuments (Roman Theater in Orange, Musée d’art et d’histoire and Arc de Triomphe d’Orange) during the day, and then enjoy the Sound Odyssey show in the evening. The date of the Sound Odyssey is chosen when the ticket is purchased, and the monuments can be visited on the same day or the following day.

ARTICLE 2: GROUP TICKETS ON SALE

Group tickets entitle the holder to access the Odyssée Sonore show produced by the Roman Theater in Orange for a specific period, at a preferential rate. A group is made up of a minimum of 20 people. Below this number, the individual rate corresponding to the visitor category will be applied. A deposit of 50% of the order amount may be required at the time of booking. This deposit is non-refundable.

2.1. School groups The school group rate applies to all groups of people aged 17 and under. One accompanying adult is admitted free for every 8 paying children (the teacher is considered an accompanying adult). One driver per group is free.

2.2. Adult groups The adult group rate applies to all groups of people aged 18 and over. Admission for one accompanying adult and one driver per group is free.

ARTICLE 3: FREE GIFTS

Access to sites managed by Orange Edeis is free for wheelchair users (on presentation of a disability card) and their companions, and for journalists (on presentation of a press card). Free admission for journalists can only be granted at the ticket office, on presentation of a valid press card. For wheelchair users (with disability card), tickets can be issued online or by contacting the organizers at contact@odysseesonore.com at least 7 days before the chosen date of the show.

In the event of cancellation by Orange Edeis of the service shown on the ticket, Customer Service will contact you as soon as possible by e-mail or telephone to inform you and will offer you:
– either, if possible, with the same ticket, the rescheduling of the service concerned to a different day and/or time;
– or the refund of the ticket concerned, specifying the terms and conditions.

ARTICLE 14: PROVISION OF SHOW EQUIPMENT

14.1 Equipment provided L’Odyssée Sonore is an immersive experience requiring the provision of equipment included in the price of the admission ticket for the duration of the experience, i.e. binaural headphones from Focal and a smartphone from Crosscall. In exchange for the use of this equipment, proof of identity (ID card or passport) is required and will be returned at the end of the experience, after the equipment has been returned.

14.2 Liability – Damage – Claims Throughout the effective duration of the show, the Customer is liable for any damage caused by the equipment loaned to persons and property, and for any damage caused to the equipment, not caused by Orange Edeis or by a hidden defect in the equipment. The Customer declares that he/she is regularly insured with a reputable and solvent company for the above-mentioned damages that may occur during the rental period. In the event of damage to or total or partial loss of the Equipment, the Customer shall owe Orange Edeis a flat-rate indemnity of €500 (including VAT) per item of equipment rented, lost or damaged, in whole or in part. This compensation will be evidenced by a form completed in duplicate between Orange Edeis and the Customer, and a written declaration must be sent by the Customer to Orange Edeis. Orange Edeis also reserves the right to hold the Customer liable and to claim compensation for any damage in excess of this amount, subject to justification, which does not constitute a limitation of the Customer’s liability. The declaration of loss or theft of the equipment in no way exonerates the Customer from the lump-sum compensation.

14.3 Return of equipment All loaned equipment must be returned by the Customer in person to the reception staff at the end of the screening cycle. The Customer must return the equipment in good condition. In the event of failure to return all or part of the equipment in good condition, Orange Edeis will invoice the Customer a flat-rate fee of €500 (including VAT) per piece of equipment.
